Privacy policy

This privacy policy describes how we process the personal data of our employees and job applicants. If you send us or disclose data about other persons, such as family members, work colleagues, etc., we assume that you are authorized to do so and that this data is correct. By transmitting data via third parties, you confirm this. Please inform the respective third parties that you are transmitting their personal data to us.

Andrea Sigrist Agency GmbH, with whom you have concluded an employment contract as an employee or are applying for an employment contract as a job applicant, is responsible for the data processing described in this privacy policy.

2. data categories

We process various categories of data about you in your role as our employee/job applicant or our employee/job applicant, in particular the following categories of data:

  • Personal details (e.g. name, address, city/country, date of birth, marital status, children, names and details of family members, emergency contacts, private e-mail address, mobile number, photo, etc.);

  • Details of the employment relationship (e.g. employment contract, job title, job profile);

  • Information on working time and absence records (e.g. details of the workload and corresponding working days, attendance times, vacation and sickness absences, training and further education days, etc.);

  • Financial data (e.g. account details, payroll data, including social security contributions, expenses, travel receipts, training agreements, other expenses, etc.);

  • Data in connection with the implementation of social insurance (AHV numbers, BVG benefits, information on pension plans, social plans, etc.);

  • Information and data that we collect from you in order to evaluate your performance (e.g. performance evaluations, qualifications, minutes from performance reviews, target agreements);

    Other documents and data belonging to a personnel dossier (e.g. information in connection with disciplinary measures and proceedings under personnel law, extracts from criminal records, extracts from the debt enforcement register, social security details, your application documents, details of previous employers and reference information); withholding tax-related data / data relating to requests for child and education allowances.

3. processing purposes

We process your personal data in order to carry out our employment relationship with you. This also includes internal management and administration purposes (operation of the IT infrastructure, payroll accounting, e-mail systems, etc.), conducting personality analyses, monitoring measures if this appears necessary or useful for safety, quality or performance measurement, and other measures that are in our interest, e.g. compliance with legal requirements, fulfillment of legal obligations, compliance with official or court orders and judgments. In this sense, we base the processing for these purposes on our legitimate interest.

Furthermore, we may also process your personal data for marketing purposes (e.g. e.g. website, other websites, brochures, social media presence, publications in specialist journals and newspapers, presentations at internal or external (specialist) events.

4. profiling and automated individual decisions

We do not use profiling in HR and do not make automated decisions in individual cases.

5. data transfers

In connection with the performance of the employment relationship with you, we may also transfer your personal data to third parties, in particular to the following categories of recipients:

  • Customers who are interested in your work performance or want to see an overview of your work assignments;

  • Organization of employee events, provision of IT infrastructure, internal communication;

  • Authorities and other public bodies that perform a task involving the implementation of

of the employment relationship with you, e.g. social security institutions, social insurance and pension funds, health insurance funds, criminal record authorities, debt collection offices, withholding tax office;

– Contractual partners who support us with personnel recruitment and HR consulting, e.g. recruitment agencies;

6. announcements abroad

As in no. 5, we also disclose data to other bodies. These are only located in Switzerland.

Please also note that data exchanged via the Internet is often routed via third countries. Your data can therefore be sent abroad even if the sender and recipient are in the same country.

7 Data retention and data deletion

We process your data for as long as required by our processing purposes, the statutory retention periods and our legitimate interests in processing or for as long as storage is technically necessary. If there are no legal or contractual obligations to the contrary, we will delete or anonymize your data after the storage or processing period has expired as part of our usual processes.

In particular, we reserve the right to retain personal data for documentation and evidence purposes, including our interest in documenting processes, interactions and other facts in the event of legal claims, discrepancies, IT and infrastructure security purposes and proof of good corporate governance and compliance. Storage may also be required for technical reasons if certain data cannot be separated from other data and we therefore have to store it with this data (e.g. in the case of backups or document management systems).

8. data security

We take appropriate security measures to protect the confidentiality, integrity and availability of your personal data, to protect it against unauthorized or unlawful processing and to counteract the risks of loss, unintentional alteration, unwanted disclosure or unauthorized access.

9. rights of data subjects

To make it easier for you to control the processing of your personal data, you also have the following rights in connection with our data processing, depending on the applicable data protection law:

  • The right to request information from us as to whether and which of your data we process;

  • the right to have us correct data if it is incorrect;

  • the right to request the deletion of data;

  • the right to obtain from us the personal data concerning you in a commonly used electronic format or to transmit those data to another controller;

  • the right to withdraw consent where our processing is based on your consent;

  • the right to receive, on request, further information necessary for the exercise of these rights;

  • the right to express your point of view on automated individual decisions and to request that the decision be reviewed by a natural person.

Please note that these rights are subject to conditions, exceptions or restrictions under the applicable data protection law (e.g. to protect third parties or business secrets). We will inform you accordingly if necessary.

10. changes to this privacy policy

This data protection declaration is part of the personnel instructions. However, we may amend this privacy policy at any time. The current version can be found on our website under Vacancies or on the Kessler intranet.
